Imran Khan challenged IHC’s Toshakhana verdict in Supreme Court

PTI Chairman Imran Khan has challenged the Islamabad High Court’s decision to send back the Toshakhana case to district and sessions court for retrial, reported 24NewsHD TV channel.

In his application submitted in the apex court on Thursday, the former prime minister prayed the court to annul IHC’s decision of sending the Toshakhana case back to the retrial court with direction to decide the case within seven days.

Imran Khan also maintained that declaring admissible Election Commission of Pakistan’s plea for criminal proceedings was also against the law. The powers of Mianwali district judge cannot be exercised by a district judge of Islamabad, he added.

Toshakhana retrial in sessions court

A district and sessions court in Islamabad on Thursday accepted Imran Khan’s plea for personal exemption from the Toshakhana case hearing, ordering his appearance before the court tomorrow (Friday).

The sessions court granted an exemption to the PTI chief after his counsel Gohar Ali Khan told Additional District and Sessions Judge Humayun Dilawar that his client was due to appear before the Lahore High Court and requested the court to fix any date for hearing after July 10.

Despite the request for extended exemption, the court granted PTI chief Imran Khan a day-long exemption while instructing his counsel to ensure Imran Khan’s presence in court the following day.

The court took up the case today a couple of days after IHC Chief Justice Aamer Farooq overturned the ruling of the local court against Imran Khan’s challenge to the maintainability of the Toshakhana case and remanded the case back to the trial court to re-examine the matter within seven days.
