Justice Mazahar Ali Akbar Naqvi denounces frivolous complaints in letter to CJP

In a letter addressed to the Chief Justice of Pakistan Umar Atta Bandial, Justice Mazahar Ali Akbar Naqvi has strongly criticized the filing of frivolous complaints against him in the Supreme Judicial Council, reported 24NewsHD TV channel Thursday.
Denouncing the allegations as part of a malicious campaign against the judiciary, Justice Naqvi expressed concern over the delay in the proceedings and raised questions about the fairness of the process.
According to the established rules, complaints against judges are submitted to the Judicial Council Chairman, in this case, Justice Mazahar Naqvi himself. The chairman then assigns a council member to examine the complaint and express their opinion. In this instance, the matter was sent to Justice Sardar Tariq Masood on May 29, 65 days ago, but no opinion has been submitted yet.
Expressing his dismay over the delay, Justice Naqvi stated that the behaviour of the judge in question was unprecedented and contrary to the council's norms. He further added that the judge in question had displayed impatience and eagerness to initiate proceedings, which was uncharacteristic of any member of the Supreme Judicial Council.
"It is evident from the two letters written by the said judge on April 3 and 26 that there is a deliberate mindset against me," Justice Naqvi said, pointing out that he was the sole target of such complaints among the current judges. He emphasized that the judge's anxiety to start the proceedings and the prolonged delay in providing an opinion raised concerns about the fairness of the process.
Justice Naqvi also highlighted that the opinion period for a referred matter should not exceed 14 days, as per the established principles of justice. However, in his case, the delay appears deliberate and part of a nefarious plan.
"The courts of the world have upheld the principle that justice must not only be done but also be seen to be done," the letter read, expressing concerns that this principle might not be applied fairly in his situation.
With several complaints against other judges already with the Secretary of the Supreme Judicial Council, Justice Naqvi emphasized that he feared he might not be treated fairly and appropriately according to the law.
