The Ministry of Law and Justice has filed a review petition against the Supreme Court verdict which struck down the SC (Review of Judgments and Orders) Act 2023 after terming it unconstitutional, reported 24NewsHD TV channel on Saturday.

In its petition, the Law Ministry has beseeched the apex court to review its August 11 verdict which annulled the Supreme Court (Review of Judgments and Orders) Act 2023.

The ministry has also sought 15 days’ time for attaching additional documents along with its review petition.

The August 11 detailed verdict of the apex court in the case said that the law was “repugnant to and ultra vires the Constitution” while being beyond the legislative competence of Parliament. “It is accordingly struck down as null and void and of no legal effect,” the order said.

The order further said that any attempt by way of ordinary legislation to interfere in the scope of the SC’s powers and jurisdiction, including but not limited to its review jurisdiction, would constitute a wrong and erroneous reading and interpretation of the Constitution.
