In the Supreme Court (SC), a 40-page dissenting note has been issued by Justice Naeem Akhtar Afghan and Justice Shakeel Ahmed regarding the case against the transfer of three judges from the Islamabad High Court (IHC) on Friday.
According to the 24NewsHD TV channel, the dissenting note declared that the permanent transfer of judges is unconstitutional under Article 200 of the Constitution, which only allows temporary transfers and not permanent ones.
The judges noted in the dissenting note that the President of Pakistan had acted without proper standards and meaningful consultation.
They described the presidential notification as unconstitutional, issued in haste, and tainted with malafide intent.
The dissent note further argued that the judges' transfer notification had no legal validity.
According to the note, the process of transferring judges undermines judicial independence and violates the constitutional procedure for judicial appointments.
