Two-member bench cannot interpret constitution, says Justice Mazhar

Justice Muhammad Ali Mazhar Friday issued a 20-page additional note regarding the powers of regular benches, reported 24NewsHD TV channel.  

In his additional note, Justice Mazhar stated that a two-member regular bench does not have the jurisdiction to hear matters related to constitutional interpretation or legal provisions. 

He further highlighted that the orders issued by Justice Mansoor Ali Shah’s bench on January 13 and 16 have been withdrawn. 

The honorable court asserted that the decisions made by Justice Mansoor Ali Shah’s two-member bench hold no legal standing.

Justice Mazhar emphasized that a case concerning Article 191-A of the Constitution is currently under hearing, and notices have already been issued to the concerned parties in the case related to the 26th Constitutional Amendment. 

He added the two-member bench brought Article 191-A into discussion unnecessarily.
