Supreme Court of Pakistan IT office has uploaded the dissent order of Justice Ayesha Malik and Justice Aqeel Abbasi in reserved seats case.
Justice Ayesha Malik and Justice Aqeel Abbasi had dismissed the petitions by saying that review petitions against the decision on reserved seats were inadmissible.
Justice Ayesha Malik and Justice Aqeel Abbasi contended that review petitions of PML-N, PPP and Election Commission were dismissed. The said the scope of review petitions is limited.
The order further said the biggest point raised in the review was that PTI was not a party in the main case. The order said the issue of PTI being a party in the case was mentioned in the detailed decision.
The Election Commission of Pakistan which had itself committed contempt of court by not implementing the court verdict.
How can the Election Commission, which itself has contempt for the court's decision, challenge the decision, the decree said. Both judges said five judges hearing the case of reserved specific seats were not made part of the bench. They also raised objection to the constitutional bench hearing the review petitions, adding that after the 26th Amendment, government and political members have been included in the Judicial Commission. The Judicial Commission is nominating judges to the Constitutional Bench.
Earlier, Supreme Court of Pakistan Justice Ayesha Malik has expressed concerned over failure of apex court’s IT office for not uploading her dissent note on website in dismissal of appeal in reserved seats case.
In a letter to Chief Justice of Pakistan Justice Yahya Afridi, Justice Ayesha Malik complained that IT department was not uploading her dissent not in reserved seats case.
Justice Ayesha Malik said she and Justice Aqeel Abbasi had disagreed in reserved seats case judgment. Justice Ayesha said she gave her order at 3:11pm but IT department was not uploading their order even on next day of the order.
Justice Ayesha Malik said when She asked IT department again today, she was categorically told that IT department cannot upload this order. Justice Ayesha Malik said non-compliance by IT department is intolerable and she requested to CJP that the order be uploaded without any delay.
A copy of the letter was also sent to all the judges of the Supreme Court.
