The Federal Constitutional Court (FCC) announced an important verdict on the petition filed by employees of the KP government, who were employed during the interim government's tenure as illegal, reported 24NewsHD TV channel on Wednesday.
The court also declared the law under which services can be dismissed as legal. The Federal Constitutional Court, in its verdict, said that the interim government's duty is to dispose of daily matters.
The FCC ruled that “an interim government cannot take up any long-term decision. The interim government cannot be equal to an elected government.
The decision of every interim government is bound by the approval of the Election Commission of Pakistan.
The Federal Constitutional Court said that providing employment opportunities is a permanent decision, not a temporary one.
The FCC ruled that all the employment contracts that were taken from January 2023 to February 2024 are illegal.
The dismissal of service notice to Khyber Pakhtunkhwa government employees is not illegal. The FCC stated, “if some persons were affected, it does not mean that they were barred from their basic rights.”
The Federal Constitutional Court rejected all the petitions filed by Grade-4 employees of the KP government.
It is necessary to mention here that after the general elections, the Pakistan Tehreek-e-Insaf (PTI) government employed all the employees who were provided employment during the interim government tenure.
