The Islamabad High Court has fixed for hearing an intra-court appeal filed against the decision regarding the cancellation of the lease of One Constitution Avenue, 24NewsHD TV reported on Monday.
As many as 19 owners of apartments at 'One Constitution Avenue' have partially challenged the court’s decision regarding the cancellation of the property’s lease by filing an intra-court appeal.
A division bench comprising Justice Muhammad Azam Khan and Justice Inaam Amin Minhas will hear the appeal on Tuesday.
The appeal was filed by 19 apartment owners, who have challenged specific judicial observations made in one paragraph of the single bench verdict.
According to the petition, 19 apartment owners filed the appeal against a specific paragraph of the court’s April 30 judgment, particularly challenging observations related to third-party rights contained in paragraph 37.
The appellants requested the court to amend or set aside the observations made in the paragraph concerning third-party ownership rights.
The petition also sought restraining orders against the Islamabad administration and police from taking action against the apartment owners.
The appellants urged the court to stop the Capital Development Authority from evicting or harassing residents living in the apartments.
They further requested the court to prevent authorities from disconnecting electricity and gas supplies or forcing residents to vacate the premises before a mutually acceptable solution is reached.
The appeal stated that no eviction action should take place until a viable settlement mechanism or grievance redressal process is completed.
The petitioners also asked the court to include apartment owners in any consultative process aimed at resolving the dispute and to direct the CDA to hear their concerns during any settlement or compensation proceedings.
The intra-court appeal named the CDA and BNP Company as respondents in the case.
