The Supreme Court (SC) has granted bail to Dr Nadir, who is accused of involvement in an alleged illegal kidney transplant case on Friday.
According to 24NewsHD TV channel, a two-member bench headed by Justice Jamal Mandokhail heard the case. During the hearing, Justice Malik Shahzad questioned what a patient should do when a suitable donor cannot be found for a transplant.
Justice Malik Shahzad observed that patients could die while waiting for a transplant and that, in some cases, people were forced to seek a transplant because of their circumstances. He also remarked that relatives were often unwilling to donate a kidney.
The additional attorney general told the court that if a relative was not willing to donate a kidney, special permission had to be obtained for the transplant.
The investigating officer told the court that brick kiln workers were allegedly brought to southern Punjab and their kidneys were removed. He said a forensic examination of the doctor's mobile phone had revealed his involvement in 65 transplant cases.
Justice Jamal Mandokhail questioned whether a doctor was expected to check a patient's identity card before examining them. He also remarked that doctors were usually very busy.
The additional attorney general responded that the doctor in question was involved specifically in kidney transplants.
The investigating officer said police had also seized a prescription written by the doctor. He added that, in the present case, the doctor had been arrested before the transplant took place.
Justice Malik Shahzad observed that it was possible the transplant might never have taken place.
The additional attorney general asked the court to direct the lower court to decide the case quickly. Justice Malik Shahzad noted that subordinate courts already had a large number of cases pending.
Justice Jamal Mandokhail remarked that the heavy caseload could also indicate that people continued to have confidence in the courts. The Supreme Court subsequently granted bail to Dr Nadir in the case.
