As the local administration has decided to keep PTI President Chaudhry Pervaiz Elahi in detention for 30 days under 3 Maintenance of Public Order (MPO), the former Punjab chief minister on Monday challenged his detention order in the Lahore High Court (LHC) on Monday, reported 24NewsHD TV channel.
Earlier, the Lahore deputy commissioner issued a notification for the detention of Pervaiz Elahi.
According to the notification, Elahi is a leading member of the Pakistan Tehreek-i-Insaf and he could harm the law and order situation. Keeping in view this fact, it has been decided to detain Elahi for a month under 3 MPO.
There are three cases against the PTI president. The decision to detain Elahi was taken after the recommendations made by the police during a District Intelligence Committee meeting.
It bears mentioning that Elahi got bail on July 11 but he still is in jail.
Elahi was initially arrested on June 1 in a corruption case. He was rearrested several times after this in different cases, including two money laundering cases.
Later on Monday, Pervaiz Elahi challenged the order of his detention for one month in the Lahore High Court (LHC).
A petition filed by Pervaiz Elahi pleaded with the LHC to fix the plea for hearing on the same day and annul the orders of his detention.
The Punjab caretaker government was made a party in the petition through the chief secretary.
Besides, the additional chief secretary (Home), Punjab inspector general of police (IGP), IG prisons, and DG Anti-Corruption were also made parties in the petition.
“Cases were made on political grounds. I have been in jail for over a month despite the bail has been granted in all the cases,” Pervaiz Elahi stated in the petition.
“The court issued a notice of release to the jail authorities. Instead of releasing the petitioner, the deputy commissioner issued the detention orders,” he added.
“Detention orders by the deputy commissioner are not in accordance with the law. The court should declare the detention orders of Chaudhry Pervaiz Elahi null and void,” he demanded.
On the other hand, an appeal is ready to challenge the order to prevent the arrest of Chaudhry Pervaiz Elahi.
The Punjab government will file an intra-court appeal later today in the Lahore High Court through its advocate general.
The lawyers of the Punjab government will request the court to fix the case for hearing today.
LHC suspends single bench’s order not to arrest Ch Pervaiz
A two-member bench of the Lahore High Court (LHC) on Monday suspended the order given by the single bench of the same court not to arrest former Punjab chief minister and PTI President Chaudhry Pervaiz Elahi, reported 24NewsHD TV channel.
A two-member bench, comprising Justice Ali Baqar Najafi and Justice Alia Neelum, also summoned Elahi on August 1.
During the hearing, the advocate general (AG) said that the single bench had barred the police from arresting ex-Punjab chief minister in all cases. “So much so that it even decreed that he could not be arrested in connection with ongoing inquiries into corruption cases against him,” the AG said, and added, “The single bench’s order is against the law as well as canons of justice.”
He went on to say that Elahi was granted relief even in those cases in which he had not asked for it.
The AG told the court that the defendant was granted protective bail even in the case registered with the Anti-Corruption Establishment (ACE), Gujrat.
PTI president’s lawyer, on the other hand, opposed the AG’s arguments.
