The Supreme Court (SC) on Monday declared a person, who had been discharged in a drug case, eligible for a job in the police department, reported 24NewsHD TV channel.
During the hearing of an appeal filed against the rejection of an application for recruitment in the Khyber Pakhtunkhwa (KP) Police as a constable, the court remarked that a person did not carry the stigma of a crime after his acquittal.
A two-member bench, headed by Justice Mansoor Ali Shah, heard the case.
Davair, the petitioner, had applied for a job in the department in 2023.
Speaking on the occasion, the KP Advocate General (AG) told the court that a case had been registered against the petitioner under the Anti-Terrorism Act in 2021.
The AG said that the petitioner did not qualify for a job in the police because of his character.
Justice Mansoor Ali Shah remarked that when the petitioner had applied in 2023, how his character became bad.
Justice Athar Minallah said that when a person was discharged in a case, he did not have to pay the price for it all his life.
Justice Mansoor remarked, “It is strange that a person was not found guilty, and yet there is an opposition to his recruitment in the police.”
“If Davair had really committed a crime, then why did you give him a clean chit?” he questioned.
KP AG said that it was the prosecution department, and not the provincial government, that had set him free.
