IHC reserves verdict in Swati’s petition seeking details of cases against him

The Islamabad High Court on Friday reserved its verdict in Azam Swati’s petition seeking details of cases against him, reported 24NewsHD TV channel.

IHC Chief Justice Aamer Farooq heard the petition filed by the PTI Senator Swati against registration of cases against him by the FIA in different cities of the country. 

During hearing, Additional Attorney General Munawwar Dugal told the court that after 18th amendment, police were under the control of provincial governments. He said that the federal government did not have the jurisdiction to pass instructions to the provincial IGs. 

The CJ inquired of the AAG if the federal government even did not have an administrative control over them.  

Dugal told the court that there could be coordination on policy affairs related to the police. 

However, he said that details of cases against Swati registered in provinces could not be provided. 

Swati’s lawyer Babar Awan contended that all basic rights were policy matters and the Centre could take information from provinces. He wondered how the federal government could say that it was powerless beyond Faizabad or Attock borders. 

Awan beseeched the court that at least he should be told where the FIRs had been registered against Swati so that he could submit his bail applications. 

He said his client’s all basic rights were being affected pleading the court to pass an effective order in this regard. 

He implored the court to stop the FIA from shifting his client out of Islamabad. He said that Swati was a heart patient. He said he was only requesting the court to tell him about the number of FIRs against his client. 

The AAG said that in the petition, only provincial IGs were made respondents but the home ministry was not made a party to the case.

After hearing arguments from both sides, CJ Farooq remarked that the court would issue an appropriate order in the case. With this, the judge reserved the verdict in the petition.
