The Khyber Pakhtunkhwa Service Tribunal has declared the seniority list of officers of the Khyber Pakhtunkhwa Provincial Assembly null and void, directing authorities to conduct a comprehensive review of the records.
In its ruling, the tribunal ordered the competent authorities to reassess the service records, seniority list, appointments, and merit-based inductions of all concerned officers within 60 days.
The verdict was issued by Judicial Member Aurangzeb Khattak and Member Executive Syed Muhammad Farul Saqlain after completion of arguments in the case.
According to petitioner’s counsel Shabbir Hussain Gigyani Advocate, his client Aamir Khan was appointed as Assistant Secretary (Grade 17) in the Provincial Assembly and was placed at 12th position in the seniority list issued in 2019.
He stated that another officer, listed at the 13th position, did not see any impact on seniority despite the passage of time and subsequent appointments.
The counsel further argued that under the KP Provincial Assembly Secretariat Employees Act 2024, a new seniority list was issued, while a private individual—identified as party number three and serving as Special Secretary—was inducted on a separate post.
He maintained that seniority cannot be altered through upgradation, deputation, or reshuffling.
The tribunal set aside the order dated August 29, 2025, and directed that the petitioner’s departmental appeal be re-examined strictly in accordance with the law. It also instructed that all parties be given an opportunity to be heard before a fresh decision is made.
