Accepting the appeal filed by the Sindh government, the Federal Constitutional Court (FCC) on Thursday declared the Sindh High Court’s (SHC) verdict in the wheat quota case null and void, reported 24NewsHD TV channel.
A three-member bench of the FCC, headed by Justice Aminuddin Khan, heard the Sindh government’s appeal against the SHC’s decision.
Additional Advocate General Sindh Sibtain Mehmood, who appeared in the court, said that the guidelines given by the high court were not in line with the constitution.
Additional Attorney General Munawar Iqbal Duggal said that it was the executive’s power to formulate policies.
Justice Ali Baqar Najafi remarked that the executive formulated a policy and then announced it.
Ordering that policymaking was the executive’s job, the FCC annulled the SHC’s verdict.
The provincial government had moved the Supreme Court (SC) against the SHC’s decision dated May 31, 2023.
The owner of a flour mill had approached the SHC for receiving the wheat quota.
