Declaring the special court order related to the impounding of a vehicle by the Punjab Food Authority (PFA) null and void, the Lahore High Court (LHC) on Tuesday ruled that continued impounding of a vehicle constituted a violation of fundamental rights of a citizen, reported 24NewsHD TV channel.
In a seven-page verdict, which is being described as a judicial precedent, Justice Muhammad Jawad Zafar cited Articles 23 and 24 of the constitution and ordered that the vehicle be returned to its owner.
The high court observed that Abdul Qadeer, the petitioner, was not an accused, but the owner of the vehicle.
The LHC also ordered that the car, presently parked outside, be protected from the sunlight.
The petitioner had challenged the special court’s verdict in the high court, and said that the PFA team had impounded his vehicle which was carrying adulterated milk.
He said that he had nothing to do with the milk, and that the PFA team impounded his vehicle without taking into consideration the fact that another party, and not he, was selling the milk.
