ECP submits its objections in SC in review plea against reserved seats judgment

 Election Commission of Pakistan has submitted its objections in written form in Supreme Court of Pakistan in review petition against giving of reserved seats to PTI, reported 24NewsHD TV Channel. 

Election Commission of Pakistan contended that in apex court’s majority decision PTI was present in the court during the hearing but PTI made no request for reserved seats. 

Th ECP claimed that PTI had not demanded theses seats at any forum. The ECP said in the July 12 decision of the apex court, the Sunni Ittehad Council was replaced with PTI. 

The Election Commission said the list of reserved seats is collected before polling as per the election program. The ECP said in July 12 decision, PTI was ordered to submit a list of reserved seats but such orders after the election were against the law. 

The ECP counsel said 39 members were declared PTI members contrary to the legal procedure. The Election Commission said PTI was given relief beyond jurisdiction. It claimed the ECP was not heard in declaring the Election Act null and void and mmajority of judges did not take notice of the clarification of September 14 and October 18. 

The Election Commission counsel raised objection that case was not placed before 13-member bench before both clarifications, adding that majority decision violates Article 10A and Article 4.
