LHC annuls Punjab Health Department’s decision about upgradation of Hakeem’ post
Lahore High Court (LHC) on Monday declared null and void the decision of the Punjab government in which Unani Hakeem’s pay scale upgradation from BPS-15 to BPS-16 was declared illegal, reported the 24NewsHD TV channel.
Justice Tariq Saleem Shaikh gave a details verdict on Muhammad Ayub's petition against the Punjab health department.
According to the petition, the Punjab Finance Department through a notification issued in 2016 upgraded the post of Hakeem from Grade 15 to 16.
However, Punjab DG Health Services declared the upgradation of the post of Hakeem as illegal in November 2018, it adds.
The petitioner Muhammad Ayub filed a revision appeal before the department which was not entertained.
According to the verdict, Ayub was asked to account for the money taken after promotion on applying for retirement and pension in January 2021.
The petitioner Ayub was asked to return BPS- 16 salaries from January 2016 to January 2021, it added.
Ayub was asked to give the service book to calculate the excess amount and deposit it in the government treasury.
In case of failure to do so, Ayub's pension was also warned not to be released, it added.
The court observed that what the petitioner has taken with the permission of the competent authorities cannot be taken back.
The court ordered the authorities completion of the petitioner's pension papers in 60 days.
The 7-page decision is considered a judicial precedent for the courts.
