The Islamabad High Court on Tuesday suspended the disqualification order of Umar Amin Gandapur issued by the Election Commission of Pakistan (ECP), reported 24NewsHD TV channel.
The court sought a reply from the ECP, directing it to submit its response by February 11.
The court further directed that the ECP order regarding Ali Amin Gandapur will remain on field. The court inquired how Umar Amin became a party to this, was he not issued a notice?
Earlier in the day, MNA Ali Amin Gandapur’s brother Umar Amin Gandpur who was declared disqualified by the Election Commission of Pakistan on account of violating election code resorted to the Islamabad High Court challenging his disqualification.
The younger sibling of MNA Ali Amin Gandapur prayed to the court that the Election Commission of Pakistan could not disqualify someone on violation of code without holding summary inquiry, beseeching the court to declare the ECP’s decision null and void.
Petitioner Umar Amin Gandpur also requested the court to fix his appeal for hearing today.
The ECP on Monday disqualified Umar Amin Gandapur, who was PTI candidate for the seat of Dera Ismail Khan mayor, on violation of election code.
The petition made the chief election commissioner, regional election commission and Kamran Murtaza party to the case.
It is stated in the petition that the ECP has failed to fulfil the demands of transparency in this case.
A miscellaneous petition seeking suspension of the ECP decision has also been filed in the court.
