PHC directs KP governor to administer oath to CM-elect Sohail Afridi tomorrow
Court orders if Governor failed to administer the oath by 4pm, then Speaker of provincial assembly will do the same, Barrister Gohar hails the development as great news from judiciary
The Peshawar High Court (PHC) has directed Khyber Pakhtunkhwa Governor Faisal Karim Kundi on Tuesday to administer the oath to Chief Minister-elect Sohail Afridi tomorrow by 4pm.
PHC Chief Justice (CJ) S.M. Attique Shah issued the directive, further instructing that KP Assembly Speaker Babar Saleem Swati should administer the oath if the governor Kundi did not.
PHC Chief Justice in his short notice directed KP Governor to administer oath tomorrow by 4pm. He said if Governor fails to do so then Speaker KP Assembly will administered the oath.
The decision on the petition was announced by Chief Justice of Peshawar High Court SM Atiq Shah. The brief order said Ali Amin Khan Gandapur announced his resignation on the assembly floor. After which a new Chief Minister was elected. It is necessary for the newly elected Chief Minister to take over the office.
The PHC order said the Governor of Khyber Pakhtunkhwa has a fixed time according to which the oath-taking should be done. The Governor of Khyber Pakhtunkhwa should take the oath of office from the Chief Minister immediately.
The order said tomorrow at 4 pm, Governor of Khyber Pakhtunkhwa Faisal Karim Kundi should take the oath of office from the newly elected Chief Minister. The decision said if the Governor does not take the oath, the Speaker of the Provincial Assembly should take the oath of office from the newly elected Chief Minister on the same day.
PTI Chairman Barrister Ali Gohar hailed the development as great news from judiciary. He hoped that the transition would be completed tomorrow and the new KP government would “stay focused on public issues”.
