LHC summons Kasur DPO on July 20 over police's poor investigation
Expressing displeasure over the Kasur police's investigation, the Lahore High Court summoned Kasur DPO Aftab Phularwan to appear in person on July 20.
In its written order, LHC Justice Muhammad Tariq Nadeem directed DPO Kasur to provide an explanation regarding the conduct of the concerned ASI and the investigation of the case.
Justice Muhammad Tariq Nadeem was hearing the pre-arrest bail petitions filed by the accused, Waheed, and others.
According to the written order, the petitioners' counsel appeared before the court, while the Deputy Prosecutor General and the concerned ASI, Munawar, represented the state and presented the relevant record.
Despite the notice, the complainant was not produced before the court. The court noted that ASI Munawar, who was present in the courtroom, himself maintained that the site where the petitioners were alleged to have committed encroachment was actually in their possession. Nevertheless, when the court inquired how Section 452 of the Pakistan Penal Code could be invoked in such circumstances, the ASI persisted in his stance but failed to satisfy the court.
In its order, the LHC observed that legal requirements appear to have been overlooked during the investigation; therefore, DPO Kasur Aftab Phularwan is directed to appear in person to explain the conduct of the concerned ASI and the details of the investigation. Laer Lahore High Court extended the interim bail of the accused until the same date.
