Bring evidence, court will take action against ex-CJP: IHC CJ

Islamabad High Court (IHC) Tuesday issued a show-cause notice to journalist Ansar Abbasi and former chief justice of Gilgit-Baltistan Chief Court Rana Shamim seeking written replies within 7 days on claims made in an affidavit, reported 24NewsHD TV channel.

The court adjourned the case hearing till November 26.

Taking suo motu notice of the incident, the Islamabad High Court yesterday summoned journalist Ansar Abbasi, newspaper Editor-in-Chief and Rana Shamim to appear before the court in person.

Mr Abbasi appeared before the court, however, Rana Shamim’s lawyer appeared on his behalf as Shamim’s brother passed away.

IHC Chief Justice Athar Minallah remarked he would never take notice of the claims, if had not any trust on the IHC judges.

Judge remarked that the IHC would take action against a chief justice if a single piece of evidence would be presented before the court in support of the claim made in the affidavit.

He commented that people should have trust in the court.

IHC CJ said, “Judges must be criticized and they must also be held accountable.”

Pointing towards the newspaper Editor-in-chief, IHC CJ said that the court summoned him with a heavy heart.

Journalist Ansari Abbasi asked whether he could speak, on which, IHC CJ remarked, “What you want to say now as you have done the damage. We have not summoned you for any former judge.”

The CJ said the court tried its best to maintain the freedom of the press and also tried its best that people should have trust in courts.

“There is a difference between newspapers and social media,” he commented.

Ansar Abbasi argued that he took complete ownership of the newspaper and the court should spare the Editor-in-Chief and Mr. Amir Ghouri.

But IHC CJ remarked that he was not alone now and others too have to answer.

“If anything goes wrong in IHC, I am responsible,” he remarked and cited an IHC example while pointing it out to journalist Ansar Abbasi.

IHC CJ remarked how a person with such a position could give a statement like that.

He also commented that there are rumors that the affidavit is fake.

Journalist Ansar Abbasi said that he was just a messenger, on which IH CJ replied, “You not just a messenger but an editor of a leading newspaper.”

CJ pointing out newspaper Editor Mr. Ghouri asked whether The Guardian newspaper would publish such news in its newspaper.

Abbasi said he published news for the integrity of the court but CJ remarked the news story did not add any such thing.

Abbasi insisted that the court might continue contempt of court against him but there should be a judicial inquiry.

On which, Mr. Justice Athar Minallah replied if tomorrow someone writes an affidavit against him then there would be roving inquiry?

“We will take this matter forward. If anything like what was claimed in the affidavit happened then it must be highlighted at that time at the relevant forum. If someone like this happened in front of me, I would have taken this to the Supreme Judicial Council,” IHC CJ remarked.

CJ Athar Minallah said he and Justice Amir Farooq were not in the country when the cases against Nawaz Sharif were heard.

“The bench which heard the case was Justice Mian Gull Hassan Zeb and Justice Mohsin Akhter Kiyani. Both judges are respectable.” IHC CJ said.

Pertinent to note that the IHC took notice of the revelations made by the Rana Shamim regarding the appeals filed by the former prime minister Nawaz Sharif and his daughter Maryam Nawaz

The court on Monday summoned the attorney general and advocate general Tuesday (today).

At the same time, the court also initiated contempt of court proceedings against the journalist whose story which was published on Monday carried those revelations.
