LHC says trial court can terminate ex-parte proceedings

Lahore High Court has made key decision on petition against ex-parte proceedings and said that a petition to terminate such proceeding can be filed within 3 years and not within 30 days, reported 24NewsHD TV Channel. 

The High Court quashed decision of Additional District Judge Deepalpur and retored trial court order to terminate ex parte proceedings. 

The High Court said that the party affected by unilateral action is not excluded from the case. The court said that cases should be decided on merits and not on technical grounds. Despite unilateral action, the party can join the case at a later stage, court remarked. 

LHC order said that it was necessary to give the parties a full hearing in a property dispute. The trial court was directed to dispose of the case expeditiously according to the law.
