Imran Khan again challenges IHC Toshakhana verdict in Supreme Court

Supreme Court’s (SC) Registrar Office on Saturday returned former prime minister and PTI Chairman Imran Khan’s appeal against the Islamabad High Court’s (IHC) yesterday’s order to send Toshakhana reference back to district and sessions court for the verdict by raising objections to it, reported 24NewsHD TV channel.

One of the objections raised was that the petition did not bear the petitioner’s signatures as well as the power of attorney.

Secondly, the petitioner had not submitted Rs250 official court fee.

The third objection raised was some of the pages of the appeal were not legible.

Earlier in the day, Imran Khan for the third time filed a petition in the Supreme Court challenging the decision of the Islamabad High Court regarding again sending the Toshakhana case back to the trial court.

In his petition, the Pakistan Tehreek-i-Insaf chairman requested the apex court to annul the August 4 decision of the Islamabad High Court in which it sent back the Toshakhana maintainability case to the trial court.

Advocate Khawaja Haris Ahmad submitted the petition on behalf of Imran Khan to the Supreme Court.

The Islamabad High Court on Friday overturned the district and sessions court’s decision to declare the Toshakhana case as admissible. It again sent the case back to the trial court for hearing it anew.

IHC Chief Justice Aamer Farooq announced the reserved verdict on eight petitions filed by PTI Chairman Imran Khan who challenged the Toshakhana’s criminal proceedings in the trial court.

In its verdict, the IHC annulled the sessions court's decision that the Toshakhana criminal case is admissible and directed the sessions court that it should hear the case again and decide.

However, the IHC rejected the PTI chief’s request to transfer the Toshakhana case to another court while issuing notices for the next week on the request to restore his (PTI chief’s) right to defence.

A sessions court last month declared that the ECP reference against the PTI chief was maintainable. The decision was subsequently challenged in the IHC. At that time too, the IHC referred the case back to the trial court, directing it to decide the case again.

Moments before the IHC verdict yesterday, the Supreme Court too disposed of the PTI chairman’s appeal in the Toshakhana case on the basis of the withdrawal of the application by the petitioner.

On July 6, the PTI chief approached the Supreme Court to challenge the Islamabad High Court’s (IHC) July 4 remand to a trial court for reexamination of the maintainability of the Toshakhana case within a week.

On July 31, former premier Imran Khan once again moved to the Supreme Court, seeking suspension of his trial in the Toshakhana case after a sessions court in Islamabad rejected his request to defer his trial for some time.

On July 27, a division bench of the apex court declined Imran’s request to stay his trial in the court of Islamabad Additional District and Sessions Judge Humayun Dilawar in the Toshakhana case but urged the IHC to decide some pending petitions of the PTI chairman.
