SC constitutional bench to hear military trials of civilians case on Dec 9

The fate of over 100 PTI activists detained by military authorities in connection with the May 9 riots is expected to be decided soon as the constitutional bench of the Supreme Court (SC) on Thursday fixed the hearing of the intra-court appeals filed by the federal government in the case of trials of civilians in military courts on December 9, reported 24NewsHD TV channel. 

A six-member bench, headed by Justice Aminuddin Khan, will hear the case, while other judges on the bench are Justice Jamal Mandokhel, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi, Justice Musarrat Halali and Justice Naeem Akhtar Afghan.

The federal government in its appeals had challenged the SC’s October 2023 verdict in the military trial case.

On October 23, the SC had invalidated a section of the Pakistan Army Act, 1952, that permitted civilians to be court-martialed. 

The majority judgment was authored by Justices Munib Akhtar and Ayesha A Malik, with Justice Yahya Afridi dissenting.
