IHC upholds Dr Nadir's bail cancellation in illegal kidney transplant case

The Islamabad High Court (IHC) has dismissed petitions challenging the cancellation of bail for two men accused in an alleged illegal human organ transplant case, allowing criminal proceedings against them to continue.

According to the 24NewsHD TV channel, in a written judgement, Justice Muhammad Azam Khan upheld the decision issued by the Additional Sessions Judge on 20 July, which cancelled the post-arrest bail of Syed Adeel Haider and Dr Nadir Hussain.

The court also directed the trial court to proceed with the case in accordance with the law and deliver a decision on its merits within the prescribed time.

According to the judgement, the Federal Investigation Agency (FIA) has full legal authority to investigate the matter under the Human Organ Transplant Act. 

The verdict also referred to the transfer of Rs2 million into Dr Nadir Hussain's bank account and statements recorded under Section 164 of the law as part of the evidence available on record.

Syed Adeel Haider, who was associated with Quaid-e-Azam International Hospital, served as the coordinator of the hospital's kidney transplant programme. 

He is accused of acting as a facilitator and agent in an alleged illegal human organ transplant operation.

Dr Nadir Hussain, who worked at the same hospital as a urologist and visiting surgeon, is accused of carrying out illegal kidney transplant procedures.

A judicial magistrate had granted post-arrest bail to both accused on 9 June 2026. The FIA later challenged that decision before the Sessions Court, where the additional sessions judge accepted the agency's appeal and set aside the trial court's bail order. 

The accused subsequently challenged the cancellation of their bail before the Islamabad High Court, but their petitions have now been dismissed.
