Imran Khan challenges court's verdict to indict him in cipher case

Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan Wednesday challenged his indictment in the cipher case in the Islamabad High Court (IHC), reported 24NewsHD TV channel.

The PTI chairman pleaded with the IHC to annul the trial court’s order of October 9.

He filed the petition challenging his indictment through lawyer Sher Afzal Marwat.

“The trial court wrote it received the copy of the case even though it did not receive the copy,” the petition maintained.

“The trial court also did not wait for the verdict of the High Court against the jail hearing,” it added.

“The October 9 judgement of the special Official Secrets Act Court should be annulled,” it pleaded.

The Islamabad High Court (IHC) Wednesday reserved the judgement on the intra-court appeal of Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan to provide him with facilities in the Adiala Jail and allow him to meet his family, lawyers and personal physician, reported 24NewsHD TV channel.

Justice Miangul Hassan Aurangzeb and Justice Arbab Muhammad Tahir conducted the hearing on the intra-court appeal. Sher Afzal Marwat Advocate appeared before the court.

In the appeal, the September 25 verdict of the IHC single bench was challenged.

“There is no direction in the single bench judgment to grant the PTI chairman the facility which he is entitled to,” the lawyer argued before the court.

“The single bench did not order to give B class in the judgment,” he added.

“How many cases are being heard against the PTI chairman?” Justice Miangul Hassan Aurangzeb questioned.

“Right now, he is in jail in the cipher case,” Sher Afzal Marwat Advocate told the court.

“What are you asking for in the interim order now?” the court inquired.

“We are asking for a machine for exercise,” Sher Afzal Marwat said.

“What will be its procedure? Did you get facilities in Attock Jail?” the court inquired further.

“We did not have facilities even in Attock Jail, nor do we have facilities in Adiala Jail. It is not being allowed to meet personal physician, family and lawyers,” Sher Afzal Marwat added.

“We issue a notice to the other party and seek their response. We also sought the implementation report from them,” Justice Miangul Hassan Aurangzeb said.

“What do the prison rules say? You should assist the court in this regard as well,” the judge said to Sher Afzal Marwat who then read out the jail rules before the court.

“One month has passed since the single bench gave its verdict, but the jail authorities did not allow the facilities,” the lawyer said.

“We visited the jail. It was full of diseases itself. We will pass the judgement in this regard,” Miangul Hassan Aurangzeb said.

The court then reserved the judgement on the PTI chairman’s plea to provide him with facilities in Adiala Jail and allow him to meet his family, lawyers and personal physician.
