Justice Qazi Isa says still has not received SC order about him
Questions why SC order was released to media before being sent to him: Judge not included in any of SC benches hearing cases next week
As the Supreme Court issued its roster for next week with Justice Qazi Faez Isa not a part of any of the benches, the apex court judge has expressed shock at the release of the February 11 order to the media in violation of settled practice, reported 24NewsHD TV channel on Saturday.
In a letter sent to the Supreme Court registrar on February 12, Justice Qazi Isa said that he was yet to receive the order in which he was asked not to hear cases involving the Prime Minister of Pakistan. He said why it was released to the media before being shared with him.
On February 11, the Supreme Court had ruled that Justice Qazi Isa should not hear cases related to Prime Minister Imran Khan.
In a letter written to SC Registrar Khawaja Daud, Justice Qazi Isa stated that an order was passed and released to the media before being sent to him. “This is shocking since as yet I have not received the file with order/judgment,” he said in the letter.
The letter further states that it is a settled practice that after the judge heading the bench the chief justice writes the order and sends it to the next senior judge and so on. However, Justice Ijazul Ahsan apparently received the letter but he [Justice Isa] did not.
“And the world knows of it before I have seen it,” he added.
Justice Isa raised five questions before the apex court registrar. He asked as why the court order was not sent to him and why the settled practice of sending it to the next senior judge was not followed. He further questioned how the judgment was released to the media before he read it let alone sign it in agreement or disagreement. Justice Isa remarked why the judgment was released to the media and also asked the registrar to provide him case file so he finally read the judgment.
Court’s order
The order issued by the court has suggested Faez Isa J. not to hear the cases concerning the premier: “The Hon. Chief Justice of Pakistan, therefore, observed that in these circumstances it would not be proper for the Hon. Judge to hear the matter considering that he had already filed a petition against the Prime Minister of Pakistan, in his personal capacity. Therefore, to uphold the principle of un-biasness and impartiality, it would be in the interest of justice that the Hon. Judge should not hear matters involving the Prime Minister of Pakistan,” the order states.
SC roster for next week
This did not end here, as the court roster issued by the Supreme Court on Saturday for next week, Justice Qazi Faez Isa was not included in any of the five benches.
