LHC restrains govt from taking disciplinary action against FC College land

Lahore High Court has restrained Punjab government from taking disciplinary action regarding FC College land in Neela Gumbad Lahore, reported 24NewsHD TV channel on Thursday.

Court sought report from Punjab government on FC College's request.

Court remarked that if lease rent is to be taken from college administration, notice should have been given before proceeding.

Court directed Punjab government's law officer to submit report at next hearing.

Justice Ahmed Nadeem Arshad issued order on FC College Registrar's request.

FC College Registrar pleaded that Punjab government forcibly occupied on June 11 and government's move to cancel lease is illegal.

Possessed land should be returned till final decision, FC College's request.

Petitioner’s lawyer submitted that land was leased to FC College in 1915 and lease period was extended till 2048 in 2018.

Objection was raised by Punjab government on admissibility of petition.

Additional Advocate General Punjab informed the court that petitioner has not deposited the lease amount since 1975 and non-payment of lease fee is a breach of agreement.

Law Officer said land was acquired for educational purpose but was used for commercial. 

Punjab government requested the court that the petition should be declared inadmissible and dismissed.

The High Court sought a report from the Punjab government after hearing the arguments of the parties.
