Justice Mansoor, Justice Munib clarify their points of view in fresh letter

Justice Mansoor Ali Shah and Justice Munib Akhtar of the Supreme Court of Pakistan on Wednesday wrote a fresh letter, clarifying their points of view about the minutes of the meetings of the Judicial Commission that were made public. 

In their letter, Justice Shah and Justice Akhtar said that as members of the committee they decided to form a full court on the 26th Amendment. They said the case was not fixed for hearing, in violation of the committee’s decision. They said they again wrote a letter on November 4 when the case was not fixed for hearing.

They said that they were not given the notes written by the chief justice on their decision. They said the chief justice read out his note at a meeting of the Judicial Commission. They said the Judicial Commission was not the right forum to take up this issue.

They said it was stated in the minutes of the Judicial Commission meetings that the matter of formation of the bench had been sent to the Constitutional Bench and the Constitutional Committee. They said the Constitutional Bench and the Constitutional Committee did not exist at that time.
