SC orders to prepare list of cases under Article 184 (3)
The Supreme Court has ordered to prepare a list of cases under Article 184 (3), reported 24NewsHD TV channel on Friday.
Sources informed that a 3-member committee of the Supreme Court under the chairmanship of Chief Justice of Pakistan, Justice Qazi Faez Isa took a major decision and ordered to prepare a list of cases under Article 184(3).
According to sources, the Registrar Supreme Court has been ordered to submit the list of cases under Article 184(3). Apart from this, the committee has also ordered the Registrar Supreme Court to submit a list of cases related to the interpretation of the Constitution.
A 5-member larger bench of the Supreme Court will be constituted for hearing the constitutional cases.
Justice Sardar Tariq and Justice Ijazul Ahsan participated in the meeting of the committee.
The Supreme Court of Pakistan, under article 184 (3) of Pakistan, can act on its own (which means suo motu notice) or on the application of any person with the condition that if the SC considers that any of the rights mentioned in the Fundamental Rights Chapter, is violated and that rights involve the public importance.
Of lately, the excessive use of Article 184(3) has triggered a debate in the legal community about whether Apex Court is encroaching on the jurisdiction of the legislature and executive.
