LHC suspends Income Tax notice sent to Ittefaq Sugar Mills

The Lahore High Court (LHC) on Monday suspended the Income Tax notice of over Rs2.33 billion sent by the Federal Board of Revenue (FBR) to Ittefaq Sugar Mills, reported 24NewsHD TV channel.

The high court also ordered the FBR’s Inland Revenue commissioner to decide on the appeal filed by Ittefaq Sugar Mills against the income tax levied within 30 days.

Justice Jawad Hassan of the LHC heard the petition filed by the mills against the notice while Muhammad Mansha Sukhera Advocate appeared in the court on behalf of the petitioner.

Advocate Sukhera told the court that the FBR additional commissioner had sent a notice to his client without taking into account his income. “This prompted us to file an appeal with the Inland Revenue whose commissioner twice granted a stay but did not decide on the appeal,” he said, and added that the commissioner could not grant stay in the case for the third time.

Counsel for Ittefaq Sugar Mills recalled that the LHC had already granted stay in such cases before. “Therefore, it is prayed to the court to suspend the Income Tax notice sent to my client,” he requested.
