The Lahore High Court dismissed the petition against the arrest of Fawad Chaudhary after seeing the FIR registered at Islamabad police station, reported 24News HD TV Channel on Wednesday.
LHC Justice Tariq Saleem Sheikh heard the petition and told the petitioner's lawyer that the FIR has been registered in Islamabad, so how can he cancel it?
Justice Tariq said if the petitioner satisfied him as per the law, he will give the decision. The LHC judge added that the case before him is one of habeas corpus, while the FIR has been produced in the court, so now how can it be called habeas corpus?
On the other hand, Fawad Chaudhry's lawyer said this application (petition) is admissible as the accused was in Lahore Services Hospital when the High Court ordered his production to the police.
Earlier, IG Punjab and Additional Advocate General appeared in court and told the Justice that a case has been registered against Fawad in Islamabad's Kohsar Police Station.
Additional Advocate General Jawad Yaqub also told the court that Islamabad Police came to Lahore and were present everywhere.
While the IG Punjab Dr Usman Anwar told the court that Fawad Chaudhary was not in the custody of Punjab Police and if he had known in time, would have produced the accused in court anyway.
A copy of the permission to lodge an FIR against Fawad Chaudhary has been submitted to the court.
