FCC annuls PHC decision regarding recruitment of Karak Hospital employees

The Federal Constitutional Court has annulled the decision of Peshawar High Court regarding the recruitment of Class IV government employees in DHQ Hospital in Karak, reported the 24NewsHD TV channel on Wednesday. 
In its decision, the court pronounced that the process of public appointments is based on fundamental constitutional rights.
Under the Constitution, every citizen has the right to employment in the federal and provincial governments.
Citizens can get their real constitutional right only if the appointment process is transparent and fair.
Deviation from the criteria of recruitment is a constitutional violation and undermines public confidence in the government system. 
Low-level appointments like Naib Qasid, Khakrob and Chowkidar require utmost caution and honesty.
Appointments to posts with low educational requirements are a sacred trust. Recruiting authorities are accountable to Allah Almighty for misuse of authority. Employees’ salaries are paid from the national treasury, not from the pockets of officials.
Not selecting eligible candidates is a betrayal of public trust and a violation of rights. The court declared all the recommendations of the first and second selection committees illegal.
The Khyber Pakhtunkhwa government was ordered to complete the recruitment process again as per the law.
The court directed the completion of the entire recruitment process within 60 days and the submission of a report to the Deputy Registrar Judicial.
The court ordered the initiation of immediate departmental action against the negligent officers and officials. An advertisement was issued for DHQ Hospital Karak in February 2020. On the recommendation of the selection committee, the Peshawar High Court issued a stay order.
