Punjab Janashini Ordinance, 2021 promulgated

Punjab Governor Chaudhry Muhammad Sarwar on Tuesday promulgated ‘Punjab Janashini Ordinance, 2021’ under which heirs of a dead person will no longer need to approach a court to inherit his or her transferable or non-transferable properties, but the National Database and Registration Authority (NADRA), reported 24NewsHD TV channel.
The NADRA will then issue to the citizens properties’ ‘Family Registration Certificate’ for which special counters are being set up at all NADRA offices across Punjab.
After the death of a person, his or her heirs will have to submit an application to the NADRA for the possession of properties left behind by the dead person following which the latter will place an ad in two newspapers; one Urdu and one English. And if none objects to it within 14 days, the applicants will be issued the Janashini certificate.

NADRA’s janashini certificate will be just like the one issued by a court, and the heirs will only approach the court for the settlement of complicated property disputes. For example claimants to a dead person’s property will be able to take the case to a court in the event of NADRA’s failure to identify real heirs of the deceased.
The applicants will have to attach the death certificate of their elder, copies of their national identity cards, details of the properties they were claiming with their application besides providing their details to the NADRA.
A citizen will only be able to approach the court when he thinks that he has been deprived of the janashini certificate by NADRA without any justification.
