AJK election shake-up: New ordinance expands powers, tightens party laws

The government of Azad Kashmir has promulgated the Elections (Amendment) Ordinance 2026 with immediate effect, introducing a series of key changes to the existing electoral framework.

According to official sources, the ordinance amends the Election Act 2020 with the aim of aligning the electoral system with modern requirements. The government maintained that immediate legislation was unavoidable given the prevailing situation, emphasizing the need for timely reforms.

One of the significant provisions of the amendment allows refugees from 1989 to register their votes at their current place of residence. Authorities say the move is intended to facilitate refugees in exercising their voting rights more conveniently.

The ordinance also grants expanded powers to the Election Commission of Azad Jammu and Kashmir to update electoral rolls. Officials claim that these enhanced powers will ensure timely and transparent revision of voter lists.

In a notable clause, the ordinance stipulates that any branch in Azad Kashmir of a political party banned in Pakistan will also be automatically prohibited. Additionally, laws governing political parties have been made more stringent, widening the scope for bans.

The government has expressed confidence that the amendments will strengthen electoral transparency and discipline, and contribute to a more credible democratic process in the region.
