Court wouldn’t bother taking action if executive was doing its job: IHC

Islamabad High Court heard a case relating to the reported displeasure of the government over IHC’s order of releasing the prisoners serving jail time for petty crimes, and remarked: “We didn’t have to bother taking any action if the executive was doing its job.”

The law secretary presented before the court to represent the government to whom IHC CJ asked if he refuted the statement associated with your department.

On this, the concerned secretary said apologetically, “We had to rebut this statement but which we could not do.”

Justice Athar Minullah said “It’s shameful,” and added, “How can we ignore the overcrowded prisoners in jails? We didn’t have to bother taking any action if the executive was doing its job.”

The IHC had taken this decision in view of the growing spread of the coronavirus that it feared could contaminate the prisoners more likely.

Afterwards, the court demanded the World Rule of Law Index that ranked Pakistan as 117th country.
