The Supreme Court has disposed of PTI Chairman Imran Khan’s appeal in Toshakhana case on the basis of withdrawal, reported 24NewsHD TV channel.
During the proceedings on Friday, the apex court also directed the trial court not to decide the Toshakhana criminal case until Islamabad High Court’s final verdict.
Three-judge bench led by Justice Yahya Afridi heard the case.
Judge replaced
Earlier in the day, the Supreme Court changed the three-judge special bench hearing the petition filed by PTI Chairman Imran Khan against his trial in the Toshakhana case.
New cause list was issued on Friday morning, according to which Justice Hassan Azhar Rizvi replaced Justice Mazahar Ali Akbar Naqvi on the bench. Other two members are Justice Yahya Afridi and Justice Musarrat Hilali.
On Wednesday last, the Supreme Court had rejected Imran Khan’s plea seeking stay on the ongoing trial court’s proceedings against him in Toshakhana case and asked the petitioner to wait for the high court’s order.
A three-member bench of the apex court headed by Justice Yahya Afridi and comprising Justice Mazahar Ali Akbar Naqvi and Justice Musarat Hilali heard Imran Khan’s plea seeking for leave to appeal under Article 185(3) of the Constitution against the Islamabad High Court (IHC) order dated 27-07-2023.
The PTI chairman the other day had moved the apex court for suspending the trial court proceeding against him in Toshakhana reference till the decisions of his pending pleas, including the question of jurisdiction, before the IHC.
