SC summons LHC registrar on plea filed by late judge Arshad Malik’s wife

A five-member constitutional bench of the Supreme Court headed by Justice Aminuddin Khan on Friday issued notice to Registrar of Lahore High Court (LHC) and ordered him to appear before the bench on next date of hearing on a petition filed by late former judge Arshad Malik’s wife who is seeking release of his pension, reported 24NewsHD TV Channel.

During hearing of the case, lawyer of the petitioner prayed that the late accountability court judge was dismissed from the service on the orders from Lahore High Court as he was conducting hearing of references involving some senior political leaders.

On this Justice Hassan Azhar Rizvi questioned “Is this the duty of any judge to hold meeting with political leaders at their homes?”

The petitioner’s lawyer adopted the stance that the former judge challenged his removal from service which was pending in the Lahore High Court at the time of his death.

He said that as per law only affected judge is allowed to file review petition not his widow. He further said that the court should convert his removal as enforced dismissal and hear this petition on humanitarian grounds. 

It is necessary to mention here that the ex-judge Arshad Malik was dismissed from service after a video scandal.

Judge Arshad Malik was conducting hearing Al-Azizia and Flagship reference filed against former Prime Minister Nawaz Sharif.
