The Supreme Court (SC) sought the record of 8,600 acres of National Park land in the case against sealing Monal Restaurant and Wildlife Board offices in Margalla Hills
A three-member bench, headed by Chief Justice Qazi Faiz Isa, conducted the hearing. The Supreme Court ordered the top officer of the Military State Office to appear in person at the next hearing on March 21.
Addressing the Additional Attorney General, the Chief Justice said: “When someone powerful comes along, you lose your breath. Don't flout the law.”
The Additional Attorney General said: “MEO says it is military land”
The Chief Justice said there is no military land, the land belongs to the government of Pakistan.
He said a simple question whether it is owned by CDA or by someone else is asked.
Lawyer Salman Akram Raja appeared in court on behalf of Monal Restaurant.
The CJ asked if RVF is an institution.
Salman Akram Raja said this is a project of the Pakistan Army which is related to the Farms and Defense Division,
The CJ said: “Is this under the Constitution? Can the Infantry Brigade file such a request tomorrow? Lawyer Salman Akram Raja says that the civil case in this regard is being heard in the lower court.
“Our case is that the Monal management is ready to give rent to both RVF and CDA,” he added.
“Who gave you the lease? Was it given by CDA? “Your lease is over, Tata bye bye, ” the CJ asked Salman Akram Raja.
Justice Irfan Saadat Khan said, “On one hand you say that CDA is not the owner, on the other hand you say that the lease from RVF is legal.”
Chief Justice Qazi said: “you cannot change the landlord at will”
“You are asking for a degree in favour of RVF. You say that eight thousand and sixty-three acres of land is owned since 1910, then show the records. Relying on a piece of paper that doesn't even have anyone's signature on it.
In November 2016, Gross Farm returned to challenge the CDA if it had been affected
“If you want to continue this comedy show, it's up to you,” CJ told Monal's lawyer.
“I am serious”, lawyer Monal Salman Akram Raja
“Who has come from the Military State Office,”
"Have you brought the original record with you,? Bring all the original files to the next hearing," CJ ordered.
