No compromise on rights of children, rules Lahore High Court
Court annuls agreement signed to deprive minor of right to inheritance; Rules it is father’s duty to bear expenditures of his child; Asks courts to intervene if child’s rights are being infringed upon
The Lahore High Court (LHC) on Wednesday declared categorically that there could be no compromise on the rights of children, reported 24NewsHD TV channel.
In a five-page verdict, penned down by Justice Mohsin Akhtar Kayani, which is being described as a judicial precedent, the judge declared the agreement signed to deprive a child of his right to inherit the property null and void.
The judge wrote that the rights of a minor could not be snatched from him or her with the mutual consent of his or her parents, and that as per the Islamic law, bearing the expenditures of a child is binding on his or her father.
The high court also asked family courts not to recognize those compromises or agreements which infringed upon the rights of a minor, and added that it was obligatory on courts to intervene if the rights of a minor were being encroached upon.
The court declared controversial conditions related to the rights of a child null and void and something which could not be enforced.
The judge authored the verdict on the petition filed by a citizen named Muhammad Waleed Arshad.
