The Islamabad High Court has rejected a constitutional petition against the voting method for the overseas Pakistanis saying that the court does not regard the legislation done by the parliament is based on mala fide intention, reported 24NewsHD TV channel.
IHC Chief Justice Athar Minallah heard the case on Monday.
While hearing the petition, the chief justice remarked that the parliamentary legislation could not be termed mala fide. He said that the court expected that the election commission would fulfill its constitutional obligations in this regard.
After listening to the arguments by the petitioner’s lawyer, CJ Minallah dismissed the petition declaring it non-maintainable.
In his ruling on June 2, the IHC chief justice had observed that amendments to the Elections Act made by the incumbent government had not deprived overseas Pakistanis of their right to vote in general elections.
He advised the petitioner to have faith in parliament as it was the supreme legislative institution of the country which should be respected.
The petitioner, an advocate, contended that the previous government had given the right of vote to overseas Pakistan, but recent amendments to the Elections Act had deprived them of this right.
