Civilians' trial in military court case: SC releases order of 2nd hearing with add'l note

With an additional note from Justice Yahya Afridi, the Supreme Court (SC) on Tuesday issued an order for the second hearing of the trial case of civilians in military courts.
According to the 24News HD TV channel, Justice Yahya Afridi urged the Cheif Justice of Pakistan (CJP) to constitute a full court to hear the proceeding of the case for the establishment of harmony in the SC, the integrity of the institution and the trust of the people.
Justice Yahya Afridi also said that the decisions made on petitions about the civilians' trial in military courts without a full court will reduce its validity and value.

Key Points of Justice Yahya Afridi's Note:
-A full court should be constituted on petitions against the trial of civilians in military courts and these applications should be set before the full court as the judicial system depends on public trust.
-In the current situation, the government is completing its term and the people are preparing for new elections. In such circumstances, political discussions are taking place on this bench.
-A full court should be formed for the establishment of harmony in the court, the integrity of the institution and the trust of the people.
-I neither agree nor disagree with the objections on the bench of Senior Judge Justice Qazi Faez Isa. In the current situation, the inevitable and serious matter is the objection of the members of the bench.
-I do not want to say anything about the legality of the objections of the senior judge at this stage of the court proceedings.
-The senior judge's note of objection on the bench has now become public.
-In these circumstances, the Chief Justice of Pakistan should urgently form the full bench of the Supreme Court.
-Decisions made on petitions without a full court will reduce its validity and value.
-It is possible to restore public confidence in the judicial system by revisiting the issue of the full bench formation.
