Rs35m fine is illegal, based upon baseless notions: Sarina Isa

Sarina Isa – the wife of Supreme Court’s Justice Qazi Faez Isa – on Tuesday said the order issued and fine imposed by Commissioner Inland Revenue and International Taxes Zone Zulfiqar Ahmed was based upon baseless notions without understanding the facts.
According to 24NewsHD TV channel, Sarina said this in her reply to the order in which a fine of Rs35 million had been imposed on her. This order was passed on Sept 14 after which a notice had been sent to her for paying the amount.
In her reply, Sarina attached the 164-page order which she challenged, saying the document was illegal and issued without hearing her.
According to Sarina, the tax authorities did not take into account her agricultural income and the salary she received during her service as a teacher. Moreover, the properties sold in Karachi were also not shown in her income.
Sarina again said that the details of tax returns submitted in the past were not provided to her despite repeated requests. Her final statement was also not recorded before issuing the order and imposing fine, she added.
As soon as she received the Sept 14 order, Sarina in a statement had stated that Zulfiqar had created an “artificial tax liability of over Rs35 million”.
“I don’t even know if he wrote the order himself,” she said, vowing to challenge the FBR verdict. Under the Supreme Court June 19 order, Sarina may avail all legal options against the FBR order.
She said the FBR official while rejecting her comprehensive replies submitted in response to each of his eight notices held her liable to Rs35 million.
“Mr Zulfiqar in his notices referred to documents and information which I repeatedly requested [but] was not provided. This did not prevent him [to use these documents] against me. The voluminous order too does not attach these documents,” she noted.
Isa’s wife said in her reply dated August 28 she had asked the official for a personal hearing but Zulfiqar passed the order without once hearing me. “He has condemned me unheard.”
