SPSC challenges SHC interim orders in Federal Constitutional Court

The Sindh Public Service Commission has challenged six interim orders of the Sindh High Court in the Federal Constitutional Court over the Combined Competitive Examination results.

The appeal was filed through senior lawyer Hafiz Ehsan Khokhar.

The commission asked the Federal Constitutional Court to immediately suspend the Sindh High Court orders issued between May 14 and June 30.

According to the appeal, the high court had suspended the results of the Combined Competitive Examination through an interim order.

The commission said that 4,340 candidates appeared for the written examination, and only 70 were declared successful.

The appeal said seven candidates who were declared unsuccessful approached the Sindh High Court within seven days of the results.

The commission said the high court issued a unilateral order stopping the examination process without hearing the Public Service Commission and the 70 successful candidates.

According to the appeal, the high court directed the vice chancellor of IBA University Sukkur to re-examine the answer copies of the seven unsuccessful candidates.

The commission argued that the Recruitment Management Regulations 2023 impose a complete legal bar on re-examination of answer copies.

It said constitutional courts, in light of settled Supreme Court judgments, cannot order re-examination of examination papers.

The commission maintained that the Sindh High Court exceeded its jurisdiction by issuing the interim orders.

Further proceedings will be held after the Federal Constitutional Court takes up the appeal.
