SC’s Justice Mazhar says CB has power to hear 26th Amendment case 

Justice Muhammad Ali Mazhar of the constitutional bench (CB) of the Supreme Court (SC) said on Wednesday that the bench could hear the 26th Amendment case, reported 24NewsHD TV channel.

During the hearing of 36 petitions filed against the 26th Amendment, the judge remarked that if need arose, all judges could be included in the bench. “I am surprised that you are asking for the judges of your choice,” he said while addressing the Supreme Court Bar Association’s (SCBA) lawyer Abid Zuberi.

An eight-member bench, headed by Justice Aminuddin Khan, heard the petitions.

Zuberi said that the constitutional committee had the power to form constitutional benches.

Addressing the judges, he said that they all had judicial powers, which could not be taken away from them.

Justice Ayesha Malik asked Zuberi the reason for his demand for the formation of a full court.

She asked whether an order could be given to the judicial commission. “Or should we assume that the commission is superior than the apex court?” she questioned.

The case’s hearing was adjourned until October 20.
