All legal conditions must be met before joint property’s auction, rules LHC

The Lahore High Court (LHC) on Saturday declared the fulfilment of all legal conditions mandatory for the auction of a joint property, reported 24NewsHD TV channel.

Objecting to the approval of a land’s auction for Rs3.6 million despite the fact that a bid of Rs5 million was offered, the LHC declared the Executive Court’s order of ratification of the auction null and void, and ordered the court to redetermine the market value of the affected party’s share in the property.

Justice Muhammad Shahid Mehmood Sethi remarked that the court gave the buyer an opportunity to pay to Ghulam Muhammad, the petitioner, the amount for the latter’s share in land according to the market value. “If the buyer does not pay that amount, the auction of the petitioner’s land will be held again,” he ordered.

The high court ruled that the protection of the rights of all shareholders and transparency in auction were necessary. 

The court sent the case back to the Executive Court, and ordered it to decide it within three months.
